1. Scope and contracting party

These terms govern every purchase made through moud.swiss. Your contracting party is M'OUD Switzerland GmbH, Tösstalstrasse 14, 8483 Kollbrunn, Switzerland, UID CHE-215.784.601.

We sell to consumers and to businesses. Where a clause applies only to consumers, it says so.

2. How a contract comes about

The presentation of our fragrances on this site is an invitation to order, not a binding offer. By completing the checkout you make a binding offer to buy.

The confirmation email we send immediately afterwards acknowledges receipt of your order; it does not yet conclude the contract. The contract comes about when we confirm dispatch, or — for a reservation of an unproduced batch — when we confirm the reservation in writing.

3. Reservations of unproduced batches

We produce in numbered batches and open reservations before a batch is filled. Where a fragrance is marked as reserved rather than in stock, the following applies in addition.

The expected dispatch window shown at the time of reservation is an estimate based on the state of production, not a fixed delivery date. We will tell you if it moves.

Your payment method is charged when you reserve. You may cancel a reservation at any time before dispatch and receive a full refund, including any shipping already paid. If we have not dispatched within sixteen weeks of your reservation, we refund in full without you having to ask.

4. Prices

Prices are shown in the currency you select and include Swiss VAT where applicable. Duties, import VAT and customs clearance fees in the destination country are not included and are payable by the recipient.

Currency conversion is indicative. The amount finally charged is determined at checkout.

5. Payment

Payment is handled by our payment provider. Card details are entered directly with the provider and never reach our systems.

Ownership of the goods passes to you once payment has been received in full.

6. Delivery

We ship by DHL from Switzerland. Within Switzerland delivery is free. To the European Union we carry half the shipping cost. To all other destinations shipping is charged at cost.

Every shipment is tracked. If a shipment is refused or not collected and returns to us, the outbound and return carriage and any duties already paid are deducted from the refund.

7. Returns and right of withdrawal

Every flacon is dispatched sealed. The seal serves health protection and hygiene purposes and is marked as such.

Returns. You may request a return within 14 days of receiving the goods. A full refund requires that the flacon is unopened, the seal intact, and the item returned complete in its original packaging with all outer boxes, caps and enclosures. Please request a return authorisation at returns@moud.swiss before sending anything back; we are unable to process unannounced shipments.

Costs. The direct cost of return shipping, together with any customs or import charges, is borne by the customer. Outbound shipping charges are not refunded unless the goods were defective or incorrectly supplied.

Diminished value. An opened flacon loses its resaleability entirely, for reasons of hygiene. We reserve the right to claim compensation for that diminished value and to offset it against any refund. This does not apply where your handling of the goods was necessary to establish their nature, characteristics and functioning.

Excluded. Discovery sets, samples, engraved or otherwise personalised items and complimentary gifts are final sale. Where an order is returned in full, any samples included must be returned with it.

Customers in the European Union. Consumers habitually resident in the EU have a statutory right of withdrawal of fourteen days from receipt of the goods. Details and the model withdrawal form are set out in the Withdrawal Instructions. The provisions above on costs and diminished value apply in addition, to the extent permitted by law. Mandatory consumer protection rules of your country of residence remain unaffected.

Customers in Switzerland and elsewhere. Swiss law provides no statutory right of withdrawal for distance contracts. The return option set out above is granted voluntarily and is governed exclusively by these terms.

Refunds. Refunds are issued within fourteen days of receipt and inspection of the goods, to the original method of payment.

8. Defects

If an item arrives damaged, leaking or otherwise defective, write to us within seven days with a photograph. We replace it or refund it in full, including all carriage, and we arrange the return at our cost.

Natural raw materials vary from harvest to harvest. A difference in shade or in the opening between two batches is a property of natural material, not a defect. We name the origin; we do not guarantee identical batches.

9. Use of the product

Fragrance is for external use on the skin or on clothing. Keep it away from eyes, out of reach of children and away from direct sunlight and heat. Alcohol-based fragrance is flammable.

If you have sensitive skin or a known allergy to fragrance materials, test on a small area first. The full allergen declaration accompanies every shipment.

10. Vouchers and credits

The amount paid for a discovery set is credited against your first full bottle. The credit is single-use, is not transferable, cannot be exchanged for cash and is valid for twelve months from the date of the discovery set purchase.

11. Intellectual property

The name M'OUD, the emblem, the bottle design, all photography and all text on this site are protected. Reproduction or use beyond what copyright law permits requires our written consent.

12. Governing law and jurisdiction

Swiss substantive law applies, excluding the UN Convention on Contracts for the International Sale of Goods and excluding its conflict-of-law rules.

For consumers habitually resident in the European Economic Area this choice of law does not deprive them of the protection of the mandatory provisions of the law of their country of residence.

Place of jurisdiction is Winterthur, Switzerland, to the extent a jurisdiction may be agreed. Consumers may also sue at their own domicile.

The European Commission provides a platform for online dispute resolution. We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration body.

13. Severability

If a provision of these terms is or becomes invalid, the validity of the remaining provisions is unaffected.
